Abstract

الملخص: إن الحماية التشريعية لحماية التراث المخطوط من أهم المواضيع التي حضي باهتمام كبي على مستوى الوطني والدولي، اعتبارا للقيمة الهائلة المادية والمعنوية والعلمية التي تحوزها هذه المخطوطات دفع بالمجتمع الدولي للحفاظ عليه من خلال اتخاذ إجراءات لضمان حمايته من خلال إبرام العديد من الاتفاقيات والبروتوكولات الدولية سواء في أوقات السلم أو النزاعات المسلحة، بالإضافة لذالك لعبت دورا محوريا في الدعوة لحماية التراث المخطوط وتعزيزه وترسيخه في جميع أنحاء العالم. حيث تعددت الجهود الوطنية والتي تعد بحد ذاتها دورا حيويا لضمان حماية قانونية للتراث المخطوط،والتي تتمثل في سن القوانين والأنظمة التي تهدف على وجه الخصوص الى حمايتهم فضلا على تحديد المسؤوليات الجنائية، بالإضافة الى إنشاء العديد من المؤسسات ومنظمات والأجهزة المكلفة لذلك، حيث تعكس هذه الإجراءات الأسلوب الذي قامت به معضم التشريعات العربية.حيث يكمن الهدف من هذه الدراسة للكشف عن دور الجزائر في حماية التراث المخطوط، وبذالك اعتمدت على تحليل مجموعة من التشريعات والقوانين في مقدمتها قانون 98-04ومراسيم ونصوص التي تصب كلها في حماية التراث المخطوط ومقارنتها مع التشريعات العربية وهذا من خلال التطرق للآليات التي حددها المشرع بنص قانوني واضح وتوصلت الدراسة الى ان التراث المخطوط اعتبر من احد المكونات الأساسية للممتلكات الثقافية المنقولة،وتم تعرضه للعديد من الانتهاكات والمخاطر كالسرقة والإتلاف والنهب والتهريب والتصدير دون رخصة،وبذالك سن المشرع الجزائري الى العديد من العقوبات التي تخص الشخص المخالف للقانون الحماية بغرامة مالية والسجن وفي الأخير تم التطرق لبعض الاقتراحات التي من شانها تعزز حماية التي تكمن على ضرورة اعادة صياغة قانون جزائري بما يتناسب مع المتطلبات الجديدة لحماية التراث المخطوط ويكون منفصل عن قانون 98-04 RESUME : La protection législative de la protection du patrimoine manuscrit est l'un des sujets les plus importants qui suscitent un grand intérêt au niveau national et international, compte tenu de l'immense valeur matérielle, morale et scientifique que ces manuscrits possèdent, a incité la communauté internationale à les préserver en prenant des mesures pour assurer leur protection par la conclusion de plusieurs conventions et protocoles internationaux, que ce soit en temps de paix ou en temps de conflit armé. En outre, elle a joué un rôle central dans la défense de la protection, de la promotion et de la consolidation du patrimoine manuscrit dans le monde entier. L'objectif de cette étude est de découvrir le rôle de l'Algérie dans la protection du patrimoine manuscrit, en s'appuyant sur l'analyse d'un ensemble de lois et de lois, notamment la loi 98-04 et les décrets et textes qui se rapportent à la protection du patrimoine manuscrit et en les comparant avec la législation arabe, et ce en abordant les mécanismes définis par le législateur dans un texte juridique clair L'étude a conclu que le patrimoine manuscrit était considéré comme l'un des éléments essentiels des biens culturels meubles, et a été soumis à de nombreuses violations et risques tels que le vol, la destruction, le pillage, la contrebande et l'exportation sans licence, de sorte que le législateur algérien a adopté plusieurs sanctions qui concernent la personne en infraction à la loi protection d'une amende et d'emprisonnement Enfin, certaines propositions susceptibles de renforcer la protection de l’environnement ont été évoquées, qui reposent sur la nécessité de reformuler une loi algérienne en adéquation avec les nouvelles exigences de protection du patrimoine manuscrit et qui soit distincte de la loi 98-04 ABSTRACT : Legislative protection for the protection of manuscript heritage is one of the most important topics of great interest at the national and international levels, given the enormous material, moral and scientific value of these manuscripts. This has prompted the international community to preserve it by taking measures to ensure its protection through the conclusion of numerous international conventions and protocols, whether in times of peace or armed conflict. In addition, these have played a pivotal role in promoting the protection, promotion and consolidation of the manuscript's heritage around the world. There have been many national efforts, which in and of themselves are considered vital to ensure legal protection for the manuscript heritage. They consist of enacting laws and regulations aimed in particular at protecting them, as well as defining criminal responsibilities, in addition to establishing a number of institutions, organizations and bodies charged with this. These measures reflect the way in which most Arab legislation has taken them. The objective of this study is to uncover the role of Algeria in protecting the manuscript heritage, and for that reason I relied on analysis of a number of laws and laws, foremost of which are the Law 98-04 and decrees and texts, all of which are aimed at protecting the manuscript heritage and comparing them with Arab legislation, and this through addressing the mechanisms set out by the legislator with a clear legal text The study concluded that manuscript heritage was considered one of the basic components of movable cultural property, and it was exposed to many violations and risks, such as theft, destruction, looting, smuggling, and export without a license. In this way, the Algerian legislature enacted many penalties that concern a person who violates the law, financial protection, and imprisonment Finally, there were some proposals that would enhance the protection of the state, which lies in the need to reformulate an Algerian law in line with the new requirements for the protection of the planned heritage, and which would be separate from Law 98-04
