Abstract

There is no doubt that the issue of the crime of migrant smuggling is one of the most important topics, which we need to study and analysis, and our research about this crime is by addressing to all matters relating to the basis of different definitions, and related offenses basing on the general rules of criminal law and to focus on the elements of the crime of smuggling of migrants beginning by the physical corner, and the required nature of addressing the world's sensuous, and felt by the street from the criminal dangerous threaten worthy of protection interests by defining images of criminal behaviour to be in the crime of smuggling of migrants and the most important means of committing, the cases related to the physical element (initiation Criminal and contribute), and ending by the mental elements, what it requires in the mind about criminal intent factors inherent in the person of the actor, can be inferred from the circumstances and the facts show conclusive indication of the dangerous criminal replace criminal accountability. The legal system study for the crime of smuggling of migrants culminates research in international and national control mechanisms, through addressing what it contained international and national texts of strategies are in overcoming the Activity of smuggling of migrants and drying their resources, and what is reserved by the States concerned( reception, transit, source) possibilities and the bodies of this crime to encircle and eliminate the perpetrators
